When you publish a Notice of Formation, there are few specifications you must follow.

  • You must publish your Notice of LLC Formation in 2 approved newspapers that are in the same county as the new LLC’s principal place of business. 
  • One of the newsletters that you publish in must be a daily newspaper, and the other one has to be a weekly newsletter. 
  • You must publish your notice at least once every week for 6 consecutive weeks. 
  • After forming the LLC, you must complete the publication process within 120 days. 
  • Once you have finished the publication process and the 6 weeks of publishing is completed, the newspapers will send you an Affidavit of Publication. This needs to filed, along with a Certificate of Publication, with the Secretary of State. There is a $50 fee for when you file this. 
  • There are also guidelines when it comes to the format of the notice of formation. There are many guidelines online that will help you write your publication notice, or there are companies who will write it for you.
